IMPORTANT NOTICE
These Terms contain important provisions concerning purchase and use, diving safety and assumption of risk, warranty and returns, software and connected services, liability, governing law and disputes.
Diving is inherently hazardous and can result in property damage, serious injury, permanent disability, drowning or death. divePRO SCUBA is a supplementary aid. It is not a life-support system, primary life-preservation device, emergency rescue device, or substitute for training, certification, medical fitness, dive planning, independent judgement, buddy procedures or suitable backup instruments.
Customers and Users must read these Terms, the User Manual, the printed Safety and Regulatory Information supplied with the Product, the Warranty Policy and all warnings before purchase and use. Nothing excludes or changes any right or remedy that cannot lawfully be excluded or changed.
Online policies incorporated by reference
The Safety and Regulatory Information is a printed manual supplied with the Product and forms part of the Applicable Documentation.
1. Seller information
These Terms are issued by divePRO S.A., 1 Iroon Polytechneiou Str., Gerakas, Athens 15344, Greece. GEMI No. 166567801000. VAT No. 801935966. Website: divepro.gr. Support: support@divepro.gr. “divePRO”, “we”, “us” and “our” mean divePRO S.A.
2. Scope and application
2.1 These Terms govern sales by divePRO of divePRO SCUBA, related hardware, accessories, replacement parts and other goods expressly sold subject to them. They apply to Consumers and Business Customers unless stated otherwise.
2.2 They may apply to purchases through divePRO’s website, direct sales, authorised quotations or other channels incorporating them. If a third party is identified as seller, the sales contract is with that third party.
2.3 Business Customers may have separately negotiated distributor, reseller, OEM, framework, supply or other terms. A signed agreement prevails over these Terms to the extent of conflict. Order-specific documents prevail only for details expressly modified.
2.4 Nothing excludes mandatory consumer, statutory guarantee, product-liability or other non-waivable rights.
3. Definitions
“Applicable Documentation” means the User Manual, printed Safety and Regulatory Information, specifications, warnings, labels and instructions supplied or made available for the Product. “Business Customer” means a buyer acting mainly for trade or professional purposes. “Consumer” means an individual acting mainly outside those purposes. “Customer” means the buyer. “Digital Services” includes applications, cloud, subscriptions, accounts, data, AI, information and analytics services. “Product” means divePRO SCUBA and related items sold under these Terms. “RMA” means Return Material Authorisation. “User” means anyone using or interacting with a Product.
4. Eligibility and legal capacity
4.1 An individual Customer must be at least 18, legally capable of contracting and provide accurate information.
4.2 Purchase does not establish suitability for a minor. Where lawful and permitted by the Applicable Documentation, use by a minor must be supervised by a responsible parent, guardian, qualified instructor or dive centre.
4.3 The Customer represents that they are authorised to use the payment method, place the order and provide billing and delivery details.
5. Product information and marketing
5.1 divePRO takes reasonable steps to describe Products accurately. Images, renders, videos, simulations, colours, dimensions, weights and performance statements may be approximate or illustrative. Actual packaging, displays, interfaces and functions may differ from pre-production materials.
5.2 Except where mandatory law provides otherwise, the Customer must not rely on statements outside the product description, order confirmation or Applicable Documentation, or made by an unauthorised person. However, for Consumers, this does not exclude the binding effect of public statements, advertising and marketing information, which shall be taken into account when assessing whether the Product conforms to the contract. Fraud liability is not excluded.
5.3 Subject to law and express commitments, divePRO may change components, suppliers, materials, manufacturing, appearance, packaging, software, firmware, interfaces, specifications and functionality if the supplied Product substantially conforms to the contract, regulations and essential functionality represented at purchase. Later versions do not create an upgrade or retrofit right.
6. Orders and contract formation
6.1 An order is the Customer’s offer. An automated receipt acknowledgement is not acceptance.
6.2 A contract forms when divePRO expressly accepts, issues confirmation identifying acceptance or dispatches, whichever occurs first, subject to payment, compliance, stock and stated conditions.
6.3 Before dispatch, divePRO may reject, suspend or cancel for pricing or description errors, unavailability, suspected fraud, inability to verify information, trade restrictions, unlawful destination, suspected unauthorised resale, excessive quantity, carrier limits, force majeure or material legal, financial or safety risk. Amounts received for cancelled items will be refunded; no further compensation is due unless law requires it.
6.4 Customer change or cancellation requests before dispatch need not be accepted unless law requires. Statutory withdrawal rights remain unaffected.
6.5 Reasonable quantity limits may apply. Systematic resale, export, redistribution or commercial rental requires written authorisation.
6.6 To place an order, the Customer must complete the following technical steps: (a) select the Product(s) and add them to the shopping cart; (b) provide shipping and billing details; (c) select a payment method; and (d) review and finally submit the order. Prior to final submission, the Customer is provided with the technical means to review the contents of their cart, verify final prices and identify and correct any input errors by editing the relevant fields, including quantities or shipping and billing details. divePRO will archive the contract after its conclusion. The Customer may access the archived contract and the details of their orders through the “My Account” area of the divePRO website by logging into their customer account. The contract may be concluded in the following language: English. divePRO is not subject to any specific code of conduct within the meaning of the applicable electronic-commerce legislation. The above information is provided before submission of the order in a clear, comprehensible and unambiguous manner, in addition to any other statutory information requirements. These Terms and any individual contractual terms provided to the Customer are made available in a manner that permits their storage and reproduction. The information requirements under Article 9(1) of Greek Presidential Decree 131/2003, as in force, do not apply where otherwise agreed with a Business Customer or where the contract is concluded exclusively by email or equivalent individual means of communication.
7. Prices and payment
7.1 The applicable price appears at checkout, in an accepted quotation or order confirmation and may change before acceptance.
7.2 divePRO may reject or cancel a pre-dispatch order affected by a clerical, system, currency, tax or other price error and may offer the correct price.
7.3 Currency is specified in the order. Bank conversion and foreign-exchange fees are the Customer’s responsibility. Unless agreed otherwise, payment is due in full on order. Payment, identity, fraud and security checks may be performed.
7.4 To the extent permitted by law, title remains with divePRO until full cleared payment.
8. Taxes, duties and importation
8.1 For Consumers, the total price of the Products, including applicable VAT, taxes and known additional costs, will be clearly disclosed prior to the conclusion of the contract. Unless expressly stated otherwise, prices may exclude import duties, customs duties, tariffs, VAT, GST, sales or use tax, brokerage and clearance fees. Where additional charges cannot reasonably be calculated in advance, the Customer will be clearly informed before placing the order that such charges may apply and where possible, how they will be calculated.
8.2 Unless delivery is expressly duty paid, the Customer is responsible for importer-of-record obligations, customs clearance, permissions, duties, taxes and destination-country import compliance.
8.3 Subject to law, reasonable outbound, return, storage, customs, brokerage and handling costs may be deducted from a refund if a shipment is refused, abandoned, unclaimed or returned due to the Customer’s failure to complete import, pay charges, provide correct information or receive delivery. Refusal to pay charges creates no additional refund right.
9. Delivery
9.1 Delivery terms and any Incoterm will be specified at checkout or in order documents and may vary. If an Incoterm has no stated version, the version current on the contract date applies.
9.2 Dates are estimates unless guaranteed in writing. divePRO is not responsible for delays outside reasonable control, including customs, carriers, incorrect information, government action, disruption or shortages. Mandatory rights remain unaffected.
9.3 Reasonable partial delivery is permitted without additional charges caused solely by splitting. Customers should promptly report damage, missing Products or incorrect delivery.
9.4 For Consumers the risk of damage to the goods transfers to the Consumer only when they, or a designated third party other than the carrier, acquire physical possession of the goods. This mandatory Consumer rule prevails over any applicable Incoterm or order document. For Business Customers, risk may transfer to the first carrier unless stated otherwise, and risk transfers under the applicable Incoterm or order document.
10. Consumer withdrawal rights
10.1 divePRO provides only return, cancellation, withdrawal and refund rights required by law or expressly agreed. There is no general voluntary money-back or worldwide return programme. Qualifying EU Consumers generally have a 14-day statutory withdrawal period from delivery, subject to exceptions and conditions.
10.2 The Consumer must notify support@divepro.gr within the applicable period through an unequivocal statement identifying the Customer, order, Product and withdrawal decision.
10.3 The Product must be returned securely packaged and complete without undue delay and in any event not later than 14 days from the day on which the Consumer communicates their decision to withdraw from the contract. Unless divePRO agrees or law requires otherwise, the Consumer pays direct return cost for a non-defective Product under a cooling-off right.
10.4 Where permitted, the Consumer is responsible for diminished value caused by handling beyond what is necessary to establish nature, characteristics and functioning. This may include underwater or dive use, removed protection, salt-water or chemical exposure, account pairing, unauthorised software, modification, damage, contamination or missing accessories. divePRO may reduce the refund or reject withdrawal where a statutory exception applies.
10.5 Refunds will be processed without undue delay and in any event not later than 14 days from the day on which we are informed of the decision to withdraw. divePRO may withhold reimbursement until receipt of the goods or sufficient dispatch evidence where permitted. Defect remedies remain separate and unaffected.
11. Business Customer returns
Business Customers have no automatic post-acceptance return, cancellation or exchange right except under a signed agreement, prior written approval or mandatory law. Authorised returns require an RMA and may be subject to inspection and reasonable restocking, refurbishment, carriage and administrative charges.
12. Limited warranty
12.1 Under the Warranty Policy, the main divePRO Device, including depth and pressure sensors, is covered against defects in materials and workmanship under normal use for two years from original retail purchase. Accessories and consumable parts in the box, including straps, cables and chargers, are covered for one year. The commercial warranty applies only to hardware.
12.2 The commercial warranty supplements and does not replace mandatory statutory rights.
12.3 The commercial warranty applies only to the original end-user purchaser and is non-transferable and non-assignable, except where mandatory law requires otherwise.
12.4 For a confirmed covered defect, divePRO may repair with compliant new or used parts, replace with a new or divePRO Recertified device, or refund the purchase price on return. Mandatory remedies remain unaffected.
12.5 Replacement coverage is the remaining original warranty or 90 days from repair or replacement, whichever is longer, unless law requires more.
13. Warranty exclusions and restrictions
To the extent permitted by law, warranty excludes environmental or thermal damage; scratches and ordinary wear; consumable deterioration; water damage associated with ageing gaskets or missed maintenance; underwater button, crown or port operation unless expressly permitted; accident, misuse, fire, earthquake or dropping; failure to seal or maintain water-tightness; chemical exposure; unauthorised service or modification; software interruption or errors; failure to install mandatory updates; intensive commercial, professional, industrial or military use absent a written commercial warranty; online-auction purchases; claims for products from unauthorised resellers where rejected by divePRO; altered serial numbers; and external causes. Customers should back up data because service may delete or reformat storage.
14. Warranty claims and RMA
14.1 Before service, review online support and contact support@divepro.gr. An RMA is required before shipment. Unauthorised shipments may be rejected, delayed or returned.
14.2 divePRO may request proof of purchase from the original retailer, serial number, contact details, fault description, photographs, videos, logs, diagnostics, account information and troubleshooting.
14.3 A Customer may be responsible for shipping charges to the authorised service facility, except where mandatory consumer law prohibits this. Approved packaging, carrier and battery instructions must be followed. Return shipping and other costs are handled under the Warranty Policy and mandatory law.
14.4 Diagnosis and repair may take approximately four to six weeks from receipt. If not covered, divePRO may quote diagnosis, repair, replacement and shipping. Chargeable work requires approval unless a Business agreement states otherwise.
15. Out-of-warranty service
divePRO may inspect, charge a disclosed diagnostic fee, quote repairs or replacement, charge parts, labour, shipping, duties and taxes, or decline unsafe, impracticable or uneconomic repair. If a quotation is rejected or expires, the Product may be returned at Customer cost or handled as agreed and permitted by law.
16. Critical diving-safety requirements
16.1 Before use, every User must read and follow the User Manual, printed Safety and Regulatory Information, warnings, labels, update and recall notices and Product or application instructions.
16.2 Use is limited to appropriately and currently certified divers trained for the planned depth, gas, environment and equipment, acting within certification and experience limits, medically fit and compliant with applicable practices.
16.3 The Product may only be used within its intended use, certifications, approvals, regulatory documentation and restrictions current at sale and use. Documentation for the specific version controls.
16.4 The Product is supplementary and does not replace training, planning, decompression tables, judgement, situational awareness, buddy procedures, gas planning, emergency planning or backup instruments. Suitable independent backup equipment must be carried and understood.
16.5 The User is responsible for medical, physical and psychological fitness and assessing visibility, current, temperature, entry and exit, equipment and emergency support.
17. Inherent risks and assumption of risk
17.1 Diving involves potentially fatal risks including drowning, decompression illness, oxygen toxicity, narcosis, barotrauma, gas problems, equipment failure, entrapment, disorientation, panic, marine-life interaction, environmental hazards, rescue delay, serious injury, disability and death. No Product, algorithm, display, warning, alarm, training programme or procedure eliminates all risks.
17.2 To the maximum extent permitted by law, each User voluntarily accepts the inherent risks of diving, underwater activity, equipment and electronic-system failure. Non-waivable rights and liabilities are preserved.
17.3 The User remains solely responsible for whether to begin, continue, change or end a dive and for planning, execution, gas, depth and time, ascent, decompression, navigation, buddy communication and emergency response.
18. Electronic-system limitations
18.1 Electronic, optical, mechanical, battery, sensor, communications and software systems may fail or produce wrong results, including inaccurate or delayed readings, display loss, sensor drift, battery depletion, water ingress, calculation or alarm errors, communications failure, application failure and data loss.
18.2 Decompression and ascent outputs are model-based estimates. No model guarantees avoidance of decompression illness, oxygen toxicity, injury or death.
18.3 The User must verify gas, oxygen, conservatism, units, altitude, alarms, maximum operating depth and personal settings before every dive. Alarms may fail or activate incorrectly and must not be the sole safety control.
18.4 AR displays may distract or cause fixation, eye strain, dizziness, nausea or disorientation. Users must maintain awareness of depth, time, gas, surroundings, ascent, buoyancy, equipment, buddy and exits and stop relying on an unclear or distracting display.
19. No life-support or rescue function
The Product is not life support, breathing apparatus, primary life preservation, a substitute for required independent equipment, an emergency beacon unless expressly certified, a rescue service, a medical device unless expressly certified, or a guarantee of safety or survival. Connected, communication, location, alert and SOS features do not guarantee transmission, reception, location accuracy, response, assistance or rescue.
20. No reliance on AR, AI or information
20.1 AR, AI, marine-life identification, analytics, alerts, recommendations, planning tools, maps, navigation and environmental information are supplementary and may be incomplete, delayed, unavailable, inaccurate, interrupted, outdated or misleading.
20.2 divePRO does not guarantee identification of every hazard, marine life, environmental condition, decompression obligation, navigation condition, gas risk, malfunction, medical problem or emergency.
20.3 AI-generated, AR-presented or software-generated output must never be the sole basis for diving, safety, medical, rescue, navigation, gas, decompression or emergency decisions. Independent verification and backups are required.
21. Software and firmware
21.1 Embedded or supplied software and firmware are licensed, not sold, unless expressly stated. Source code and intellectual property do not transfer.
21.2 Software, firmware, applications, divePRO Cloud and Digital Services may be governed by the Web, App and Cloud Terms and EULA, privacy notices, subscription terms and service-specific terms. Signed agreements prevail, followed by order terms, service terms, EULA for software, then these Terms for hardware sales.
21.3 divePRO may provide security, safety, error, conformity, stability, performance, regulatory or interoperability updates. Mandatory, critical and safety-related updates must be installed before further use. Mandatory legal update obligations remain.
21.4 Subject to law and commitments, interfaces, optional features and cloud functionality may change or end, outdated versions may lose support, and newer systems may be required. Third-party devices, app stores, networks and infrastructure are outside divePRO’s control.
22. Digital Services and subscriptions
22.1 The purchase includes only hardware and digital functionality expressly identified at sale. Future or optional functionality may require compatible equipment, an application, internet, an account, subscription, further payment or other terms.
22.2 Subject to law and subscription terms, divePRO may introduce, discontinue or change plans, prices and included features. Active paid subscriptions receive required notice and cancellation rights.
22.3 Digital Services may be unavailable due to maintenance, connectivity, third-party failure, cyber incidents, restrictions, technical changes or discontinuation. Continuous availability exists only under a written service-level commitment.
23. Cybersecurity
23.1 Customers and Users must protect credentials and connected devices, use supported software, install security updates, avoid unauthorised modifications, report suspected compromise and follow reasonable security instructions.
23.2 No connected product or service is guaranteed completely secure or uninterrupted. divePRO may suspend accounts, features, connectivity or services to investigate or mitigate threats, fraud, unauthorised access, abuse or material risk.
24. Data, telemetry and privacy
24.1 The Product and services may process device identifiers, diagnostic logs, telemetry, configuration, application activity, dive logs, location-related data, sensor information and other information described in the Privacy Policy.
24.2 Personal data is processed under the Privacy Policy and mandatory law. These Terms do not replace consent where separate specific consent is required.
24.3 To the extent permitted, lawfully anonymised or aggregated data no longer relating to an identifiable person may be used for product development, performance and safety analysis, research, optimisation, fault detection, analytics, algorithms and AI development and improvement.
24.4 Support may involve necessary account, device, diagnostic, communication and service information. Customers must obtain required permissions before uploading another person’s personal data.
25. Intellectual property
25.1 divePRO and licensors retain rights in patents, inventions, designs, marks, software, firmware, algorithms, code, documentation, interfaces, databases, content, technical information and product designs. Sale transfers only limited Product and licensed-software use rights.
25.2 Except where law permits, Customers must not copy, modify, reverse-engineer, decompile or disassemble software or firmware, circumvent controls, remove notices, extract protected databases, develop competing products using divePRO IP or grant unauthorised access.
25.3 divePRO may use voluntary feedback without restriction or payment, without taking Customer pre-existing IP or overriding privacy law.
26. Product-use restrictions
The Product must not be used contrary to intended use or documentation, beyond certified limits, after removing warnings or serial numbers, following unauthorised repair, for unlawful or threatening activity, in prohibited military, weapons or surveillance applications, to interfere with security or services, or in breach of resale, export or transfer law.
27. Export controls and sanctions
27.1 The Customer must comply with applicable export, re-export, sanctions, embargo, customs, import and trade-control law.
27.2 The Customer represents that they and the destination are lawful, they are not acting for a prohibited person, and the Product will not be unlawfully transferred or used for a prohibited end use. divePRO may refuse, suspend or cancel to comply with law or investigate a potential violation.
28. Chargebacks and payment disputes
28.1 Before initiating a chargeback, the Customer should contact support@divepro.gr and allow a reasonable investigation. This does not prevent mandatory rights or legitimate disputes.
28.2 divePRO may contest a chargeback using order, authorisation, delivery, correspondence, return, activation, account and service records. Fraudulent, abusive or contract-breaching Business Customer chargebacks may result in recovery of reasonable fees and collection costs where permitted.
29. Disclaimer of warranties
29.1 This section applies only to the extent permitted by law.
29.2 Except for the Warranty Policy, express written order commitments and mandatory statutory guarantees, Products and Digital Services are supplied without additional warranties or conditions.
29.3 To the extent permitted, divePRO disclaims implied warranties of merchantability, satisfactory quality, fitness for purpose, uninterrupted or error-free operation, uninterrupted connectivity, information accuracy, third-party availability and non-infringement. The Customer determines suitability for intended lawful use.
30. Limitation of liability
30.1 Nothing excludes liability where prohibited, including applicable non-excludable liability for death or personal injury caused by negligence, fraud, wilful misconduct, gross negligence, defective products or non-waivable Consumer rights.
30.2 Subject to clause 30.1 and to the maximum extent permitted, divePRO’s total aggregate liability connected with the Product, order, these Terms, software, firmware or Digital Services will not exceed the amount actually paid to divePRO for the affected Product. Service-specific caps apply to claims solely concerning separately purchased services.
30.3 The cap applies collectively to related claims in contract, warranty, negligence, misrepresentation, restitution, statute, strict liability or another theory, except where law requires otherwise.
31. Indirect and consequential loss
Subject to clause 30.1 and to the maximum extent permitted, divePRO is not liable for indirect, incidental, consequential, special, punitive or exemplary loss; loss of profit, revenue, business, opportunity, savings, goodwill, reputation, data or use; interruption; or substitute costs. For Consumers this applies only where enforceable. For Business Customers it applies whether foreseeable or notified, except where prohibited.
32. Business Customer provisions
32.1 The Business contract comprises the signed agreement, accepted quotation or confirmation, these Terms and incorporated documents. The Business Customer acknowledges no reliance on outside representations, without limiting fraud liability.
32.2 A Business Customer is independent and cannot bind divePRO. Set-off or withholding requires written agreement or a finally determined counterclaim.
32.3 To the extent permitted, Business Customers bring claims only individually, not in class, collective, consolidated or representative proceedings. This does not apply to Consumers.
32.4 divePRO may suspend performance or require advance payment where it reasonably doubts the Business Customer’s ability to pay.
33. Business Customer indemnity
To the extent permitted, a Business Customer indemnifies divePRO against third-party claims and reasonable costs arising from unlawful resale, modification or marketing; unauthorised representations; use outside intended use; failure to pass on safety information; trade-control breach; or infringement caused by Customer materials or instructions, except to the extent caused by divePRO’s breach, negligence or unlawful conduct.
34. Recalls and corrective measures
Customers and Users must promptly comply with recalls, safety notices, field actions, mandatory updates, inspections, stop-use notices and replacement programmes. divePRO may use purchase, registration or account data for safety communications under privacy law. Continued use against a stop-use notice may invalidate coverage for resulting damage where permitted.
35. Force majeure
divePRO is not liable for delay or failure beyond reasonable control, including disaster, fire, flood, earthquake, epidemic, war, terrorism, unrest, sanctions, embargo, government action, legal change, cyberattack, telecommunications or power failure, labour or transport disruption, customs delay, carrier failure, supply-chain interruption or shortages. divePRO may suspend, allocate, substitute or cancel affected performance. Amounts paid for cancelled unfulfilled items will be refunded. Mandatory rights remain.
36. Complaints and support
Contact support@divepro.gr or divePRO S.A., 1 Iroon Polytechneiou Str., Gerakas, Athens 15344, Greece. Include name, order number, Product and serial number, contact details, issue description and supporting information. Mandatory access to regulators, consumer bodies, ADR or courts remains unaffected.
37. Governing law
These Terms, sales contracts and related non-contractual obligations are governed by Greek law, excluding conflict rules. Consumers retain mandatory protections of their habitual-residence country where applicable regardless of choice of law. The CISG is excluded for Business transactions to the extent permitted.
38. Jurisdiction
38.1 Athens courts have exclusive jurisdiction for Business Customer disputes unless a signed agreement provides otherwise.
38.2 The courts of Athens, Greece, shall have jurisdiction over any disputes. However, this provision does not override or affect the mandatory statutory rights of Consumers, including their right to bring proceedings in the courts of their country of residence.
39. Controlling language
Translations may be provided. To the extent permitted, English prevails in inconsistency. Mandatory local-language rules and legally required Consumer-favourable interpretation remain unaffected.
40. Changes to these Terms
40.1 Hardware purchases are generally governed by the Terms accepted at contract formation unless the parties agree, law requires change, or a permitted change concerns an ongoing Digital Service.
40.2 Revised Terms may apply to future purchases from their stated date and do not retrospectively remove accrued mandatory rights.
41. Notices
divePRO may notify by email, website, Customer account, application, in-product notification or another lawful method. Customers must keep details current. Formal notices to divePRO go to support@divepro.gr or its registered address unless agreed otherwise.
42. Assignment
Consumers may transfer rights where permitted. Business Customers require prior written consent. divePRO may assign to an affiliate, successor or capable party, provided mandatory Consumer rights are not reduced.
43. No third-party rights
Unless mandatory law provides otherwise, a non-party has no right to enforce the sales contract.
44. Waiver
Failure or delay in exercising a right is not waiver. A waiver must be written by an authorised representative and is limited to its stated circumstances.
45. Severability
An invalid provision will be modified to the minimum extent necessary or severed if modification is impossible. Remaining provisions continue. Consumer provisions are replaced or disregarded as mandatory law requires.
46. Entire agreement
Subject to law and signed agreements, these Terms and incorporated documents form the agreement concerning the sale and supersede prior communications on the same subject. Fraud liability is not excluded.
47. Order of precedence
The order is: signed negotiated agreement; order-specific quotation or confirmation; Product- or service-specific terms; EULA or software license; these Terms; Warranty Policy; Applicable Documentation. Safety warnings and restrictions apply cumulatively regardless of position. This order of precedence does not override mandatory statutory consumer rights or binding commercial warranty commitments.
48. Survival
Provisions intended by nature to continue survive delivery, cancellation, expiry or termination, including payment, intellectual property, data protection, warranty limitations, liability, indemnities, disputes, law and accrued rights.
49. Acceptance
By ordering, the Customer confirms acceptance, legal capacity, and accurate information. The Customer acknowledges that they have been provided with a reasonable opportunity to review these Terms, along with any incorporated software and service terms, prior to the conclusion of the contract. Use remains conditional upon reading and following all safety and operating materials.
